On 14 May last, the Enlarged Board of Appeal of the European Patent Office (EPO) confirmed in a ruling that the EPO’s decision to no longer grant patents on ‘essential organic products’, including plants such as potatoes, is legally valid. This is announced by Plantum, the Dutch trade association of growers. With this decision, the EPO has revised its earlier ruling on the interpretation of the European Patent Convention (EPC).
